CONTRACTS
CONTRACT OF SALE
REQUIRED DOCUMENTS:
REQUIRED DOCUMENTS: * identity documents (identity card or provisional/temporary identity card, passport for the foreign citizens or for the Romanian citizens residing abroad, NIF – the fiscal identification number for the foreign citizens to whom the Romanian authorities did not assign a Personal Identification Number), *the marriage certificate and the marriage contract (for Romanian citizens, if appropriate), and the translated and notarised marriage certificate (indicating the chosen matrimonial property regime, or presenting the certificate of no impediment, the contents of which should show the legal matrimonial regime of the State in which the marriage was concluded) for the foreign citizens married abroad,
* the ownership deeds (contracts of sale, deeds of partition, joining / subdivision documents, title deed, certificate of inheritance/succession, etc. which formed the basis for the seller ownership acquisition),
* the cadastral documentation (the layout and survey of the real estate property), and completion of registration,
* the tax certificate obtained for alienation purposes (one certificate for each taxpayer / vendor) attesting compliance with the obligation of tax payment for the real estate – valid 30 days from its date of issue,
* the energy performance certificate (for apartments, regardless of their area, and for independent buildings with a useful floor area of 50 sqm)
* the certificate issued by the owners’ association (for the apartments / commercial spaces located in condominiums where there is an association of owners)
* the latest invoices issued by the utility providers and the proof of their payment
** the land book excerpt for authentication (obtained by the notary public at the request of the property owner)
The aforementioned documents shall be presented in original at the time of signing the contract.
PROMISE OF SALE AGREEMENT (the Pre-Contract)
Required documents: *identity documents (identity card or provisional/temporary identity card, passport for the foreign citizens or for the Romanian citizens residing abroad, NIF – the fiscal identification number for the foreign citizens to whom the Romanian authorities did not assign a Personal Identification Number), * the marriage certificate and the marriage contract (for Romanian citizens, if appropriate), and the translated and notarised marriage certificate (indicating the chosen matrimonial property regime, or presenting the certificate of no impediment, the contents of which should show the legal matrimonial regime of the State in which the marriage was concluded) for the foreign citizens married abroad,
* the ownership deeds (contracts of sale, deeds of partition, joining / subdivision documents, title deed, certificate of inheritance/succession, etc. which formed the basis for the promisor-vendor ownership acquisition),
* the cadastral documentation (the layout plan and survey of the property) and the completion of registration (if the property is registered in the Land Book)
* the Land Book excerpt for information (obtained by the notary public at the request of the property owner)
The documents above mentioned shall be presented in original at the time of signing the contract.
EXCHANGE CONTRACT
REQUIRED DOCUMENTS:
*identity documents (identity card or provisional/temporary identity card, passport for the foreign citizens or for the Romanian citizens residing abroad, NIF – the fiscal identification number for the foreign citizens to whom the Romanian authorities did not assign a Personal Identification Number),
* the marriage certificate and the marriage contract (for Romanian citizens, if appropriate), and the translated and notarised marriage certificate (indicating the chosen matrimonial property regime, or presenting the certificate of no impediment, the contents of which should show the legal matrimonial regime of the State in which the marriage was concluded) for the foreign citizens married abroad,
* the ownership documents for both real estate properties (sales contracts, deeds of partition, joining / subdivision documents, title deed, certificate of inheritance/succession, etc. which formed the basis for the seller ownership acquisition),
* the cadastral documentation (the layout and survey of the property) and the conclusions of registration,
* the tax certificate obtained for alienation purposes (one certificate for each taxpayer / exchangor or non-exchangor) attesting compliance with the obligation to pay tax for the real estate – valid 30 days from the date of issue,
* the energy performance certificates (for apartments, regardless of their area, and for independent buildings with a useful floor area of 50 sqm)
* the certificates issued by the owners ‘association (for the apartments / commercial spaces located in condominiums where there is an association of owners)
* the latest invoices issued by the utility providers and the proof of their payment
* the Land Book excerpts for authentication (are obtained by the notary public at the request of the exchangor / non-exchangor)
The aforementioned documents shall be presented in original at the time of signing the contract.
DONATION CONTRACT
REQUIRED DOCUMENTS:
*identity documents (identity card or provisional/temporary identity card, passport for the foreign citizens or for the Romanian citizens residing abroad, NIF – the fiscal identification number for the foreign citizens to whom the Romanian authorities did not assign a Personal Identification Number), *the marriage certificate and the marriage contract (for Romanian citizens, if appropriate), and the translated and notarised marriage certificate (indicating the chosen matrimonial property regime, or presenting the certificate of no impediment, the contents of which should show the legal matrimonial regime of the State in which the marriage was concluded) for the foreign citizens married abroad,
* the ownership deeds (contracts of sale, deeds of partition, joining / subdivision documents, title deed, certificate of inheritance/succession, etc. which formed the basis for the seller ownership acquisition),
* the cadastral documentation (the layout and survey of the property) and the conclusions of registration,
* the tax certificate obtained for alienation purposes (one certificate for each taxpayer / donor) attesting compliance with the obligation to pay the tax for the real estate – valid for 30 days from the date of issue,
* the certificates issued by the owners ‘association (for the apartments / commercial spaces located in condominiums where there is an association of owners)
* the latest invoices issued by the utility providers and the proof of their payment
* the Land Book excerpt for authentication (are obtained by the notary public at the request of the donor)
The documents mentioned above will be presented in original at the time of signing the contract
For a donation of an amount exceeding Ron 25,000, the authenticated form of contract is mandatory.
LOAN CONTRACT
REQUIRED DOCUMENTS:
*identity documents (identity card or provisional/temporary identity card, passport for the foreign citizens or for the Romanian citizens residing abroad),
* the marriage certificate and the marriage contract (for Romanian citizens, if appropriate), and the translated and notarised marriage certificate for the foreign citizens married abroad
* legal persons which have the capacity of borrowers need: the Articles of Incorporation, the GMS resolution approving the signing of the Loan Agreement under the agreed conditions, the Certificate of Good Standing/Confirmation of Company Details, and the administrator’s ID document
MORTGAGE CONTRACT
REQUIRED DOCUMENTS:
*identity documents (identity card or provisional/temporary identity card, passport for the foreign citizens or for the Romanian citizens residing abroad, NIF – the fiscal identification number for the foreign citizens to whom the Romanian authorities did not assign a Personal Identification Number), *the marriage certificate and the marriage contract (for Romanian citizens, if appropriate) and the translated and notarised marriage certificate (indicating the chosen matrimonial property regime, or presenting the certificate of no impediment, the contents of which should show the legal matrimonial regime of the State in which the marriage was concluded) for the foreign citizens married abroad,
* the ownership documents (contracts of sale, deeds of partition, joining / subdivision documents, title deed, certificate of inheritance/succession, etc. which formed the basis for the seller ownership acquisition),
* the cadastral documentation (the layout and survey of the property) and the completion of registration,
* the tax certificate (one certificate for each taxpayer / vendor), attesting compliance with the obligation to pay the tax for the real estate – valid for 30 days from the date of issue (OPTIONAL)
* the land book excerpt for authentication (obtained by the notary public at the request of the property owner)
The documents mentioned above shall be presented in original at the time of signing the contract.
LEASE CONTRACT
REQUIRED DOCUMENTS:
*identity documents (identity card or provisional/temporary identity card, passport for the foreign citizens or for the Romanian citizens residing abroad, NIF – the fiscal identification number for the foreign citizens to whom the Romanian authorities did not assign a Personal Identification Number), *the marriage certificate and the marriage contract (for Romanian citizens, if appropriate) and the translated and notarised marriage certificate (indicating the chosen matrimonial property regime, or presenting the certificate of no impediment, the contents of which should show the legal matrimonial regime of the State in which the marriage was concluded) for the foreign citizens married abroad,
* the ownership documents (contracts of sale, deeds of partition, joining / subdivision documents, title deed, certificate of inheritance/succession, etc. which formed the basis for the owner ownership acquisition),
* the cadastral documentation (the layout and survey of the property) and the completion of registration,
* the energy performance certificate (for apartments, regardless of their area, and for independent buildings with a useful floor area of 50 sqm)
* land book excerpt for information (obtained by the notary public at the request of the property owner)
The documents mentioned above shall be presented in original at the time of signing the contract.
The lease may be also concluded in private form (signed by the parties without being notarised), but the enforcement quality for payment of rent is acknowledged only to contracts concluded in authentic form and to those in private form registered with the tax authorities.
LOAN‐FOR‐USE CONTRACT FOR CAR
It is the document allowing the use of a vehicle by a person other than its owner (and it is mandatory in the case of using the car outside Romania).
REQUIRED DOCUMENTS:
* identity documents (identity card or provisional/temporary identity card, passport for the foreign citizens or for the Romanian citizens residing abroad),
*the marriage certificate and the marriage contract (for Romanian citizens, if appropriate) and the translated and notarised marriage certificate for the foreign citizens married abroad* the vehicle ID document, the vehicle registration certificate and the contract by which it has been purchased, or the purchase invoice.
The documents above mentioned shall be presented in original at the time of signing the contract.
